1. Acceptance of Terms
By accessing or using Josey.ai ("the Service") at app.josey.ai, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms apply to all users including real estate agents, brokers, teams, and organizations.
2. Description of Service
Josey.ai is an AI-powered real estate follow-up assistant that helps real estate professionals:
- Automatically import leads from Facebook Ads, Google Ads, and Follow Up Boss
- Conduct AI-powered follow-up calls with leads
- Book appointments and manage a contact pipeline
- Receive SMS and email notifications about lead activity
- Track call outcomes, stages, and lead activity
3. Eligibility
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization.
4. Account Registration
You must create an account to use Josey.ai. You are responsible for maintaining the security of your credentials and all activity that occurs under your account. Notify us immediately of any unauthorized access.
5. Acceptable Use Policy
You agree to use Josey.ai only for lawful purposes and in accordance with this Acceptable Use Policy (“AUP”), which is incorporated into these Terms. See our Compliance page for additional detail.
a. General prohibitions
You must not:
- Contact individuals who have not provided a lawful basis (including prior express written consent where required) to be contacted
- Violate any applicable telemarketing, robocall, AI-disclosure, do-not-call, privacy, or consumer-protection law — including but not limited to the Telephone Consumer Protection Act (TCPA), the FTC Telemarketing Sales Rule (TSR), the CAN-SPAM Act, state mini-TCPA statutes (e.g., Florida FTSA, Washington CEMA, Oklahoma TCPA), CCPA/CPRA, GDPR, UK GDPR, PIPEDA, and CASL
- Upload, import, or process personal data you do not have a lawful basis to use
- Use the Service to impersonate any person, business, or government entity, or to spoof caller ID
- Reverse-engineer, copy, scrape, or resell any part of the Service, including the AI models, prompts, or outputs
- Use the Service to send spam, deceptive content, or to harass, threaten, or defraud any person
- Bypass or disable any safety, disclosure, or rate-limit feature of the Service (including the AI-call disclosure)
- Interfere with the integrity, security, or performance of the Service, or attempt to gain unauthorized access to any account, system, or data
b. Prohibited industries and use cases
The Service may not be used to place calls, send SMS, or send email in connection with any of the following, without our prior written approval:
- Debt collection (first-party or third-party) in any state where you lack a valid license
- Payday lending, title lending, or high-cost short-term credit offers
- Cryptocurrency, token-sale, or unregistered-security solicitations
- Nutraceuticals, CBD, kratom, dietary supplements, or weight-loss products
- Political campaigns, issue advocacy, or get-out-the-vote robocalls without written recipient consent
- Adult content, escort services, sports wagering, or online gambling promotion
- Sweepstakes, contests, or prize promotions in jurisdictions that regulate them unless fully compliant
- Contact to numbers confirmed or probable-reassigned per the FCC Reassigned Numbers Database
c. Customer representations (TCPA, TSR, state-law)
Each time you initiate an outbound campaign, you represent and warrant that:
- You have obtained and retain documentation of prior express written consent for every contact on which AI-generated or pre-recorded voice outreach is used, where required by law
- You have scrubbed your list against the federal DNC registry (in addition to Josey.ai’s automated scrub) and any applicable state DNC lists
- You are the “seller” or an agent of the seller whose goods or services are being promoted, and you are properly licensed to solicit that business in each jurisdiction contacted
- You will honor all opt-out requests (verbal, STOP, unsubscribe) platform-wide and across channels
- Any caller identification, script content, or SMS content you configure is accurate and not misleading
d. Enforcement
We may, in our sole discretion, suspend or terminate any account we reasonably believe has violated this AUP, forfeit prepaid fees, preserve and disclose account data to regulators or law enforcement, and pursue any other remedies available at law or in equity.
6. Third-Party Integrations
Josey.ai connects to third-party services including Facebook, Google Ads, Follow Up Boss, Retell AI, Twilio, Cal.com, SendGrid, and Stripe. By connecting these integrations, you agree to their respective terms and authorize Josey.ai to access and process data from those services on your behalf. You are solely responsible for ensuring you have the right to import and use any lead data from these sources.
7. AI-Powered Calls & Communications
Josey.ai uses AI voice technology to place calls to your leads on your behalf. You acknowledge and agree that:
- You are the “seller,” “telemarketer,” and/or “initiator” of every call and SMS placed under your account, as those terms are used in the TCPA, the FTC Telemarketing Sales Rule, and applicable state law. Josey.ai acts solely as a service provider at your direction.
- You are solely responsible for compliance with all applicable laws governing AI-generated calls, automated calls, and artificial or pre-recorded voice messages, including the TCPA, state mini-TCPA statutes, and state-specific AI-disclosure laws
- Every contact you instruct Josey.ai to call must have provided a lawful basis (including prior express written consent where required) and you must retain documentary proof of that consent
- Josey.ai’s AI assistants disclose that they are automated at the start of every call. You will not attempt to disable, obscure, or contradict that disclosure, and you will not instruct the Service to misrepresent that the assistant is a human
- Calls may be recorded and transcribed. In two-party-consent jurisdictions, Josey.ai plays an audible recording notice before recording begins; you are responsible for not disabling that notice
- You will honor opt-out and Do Not Call requests received on any channel platform-wide and across campaigns
- Josey.ai acts on your instructions — you remain the responsible party for all communications sent to your leads and for the content of scripts, prompts, and messages you configure
8. SMS Notifications & Communications
Program name: Josey.ai SMS Notifications
Josey.ai offers optional transactional SMS notifications delivered via Twilio to the mobile number you register in your account. SMS messages are strictly transactional — we do not send promotional or marketing messages. By enabling SMS notifications in Settings → Notifications, you agree to the following terms:
- Consent: You expressly consent to receive transactional SMS messages from Josey.ai, including new lead alerts, AI call completion and missed call notifications, task reminders, appointment confirmations, hot lead alerts, and two-factor authentication (2FA) codes
- Message frequency: Message frequency varies based on your account activity and the notification types you enable. You control which events trigger SMS alerts at any time from Settings → Notifications
- Message & data rates: Msg & data rates may apply. Check with your mobile carrier for details
- Opt-out: Reply STOP to any message to unsubscribe immediately. You will receive a confirmation and no further messages will be sent. Reply START to re-subscribe at any time
- Help: Reply HELP to any message for assistance, or contact us at support@josey.ai
- No marketing: Josey.ai will not send advertising, promotional, or marketing SMS messages
SMS messages are sent from +1 (571) 200-8443. For support, email support@josey.ai or visit app.josey.ai. Josey.ai is not responsible for delays or failures in message delivery caused by your carrier or network conditions.
9. Subscription & Billing
Access to Josey.ai requires a paid subscription. By subscribing, you agree to pay all applicable fees. All payments are processed through Stripe.
- Subscriptions automatically renew unless cancelled before the renewal date
- Fees are non-refundable except as required by law or at our sole discretion
- We reserve the right to change pricing with 30 days' notice
- Failure to pay may result in suspension or termination of your account
10. Data & Privacy
Your use of the Service is governed by our Privacy Policy, incorporated into these Terms by reference. You retain ownership of all contact and lead data you bring into Josey.ai. We process this data solely to provide the Service to you.
11. Intellectual Property
All content, features, and technology comprising Josey.ai — including the platform design, AI models, workflows, and branding — are owned by or licensed to us. These Terms do not grant you any rights to our intellectual property beyond the limited license to use the Service.
12. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted or error-free, that AI-generated calls will achieve any particular outcome, or that imported lead data will be accurate or complete.
13. Limitation of Liability
To the maximum extent permitted by law, Josey.ai and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 3 months preceding the claim.
14. Indemnification
You agree to defend, indemnify, and hold harmless Josey.ai, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, actions, demands, investigations, damages, losses, liabilities, settlements, judgments, fines, penalties, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of, or misuse of, the Service
- Any calls, SMS, or email sent from your account, including alleged or actual violations of the TCPA, the FTC Telemarketing Sales Rule, CAN-SPAM, state mini-TCPA or telemarketing statutes (including the Florida Telephone Solicitation Act, Washington CEMA, Oklahoma TCPA, and their successors), state AI-disclosure laws, or state two-party recording-consent laws
- Your breach of these Terms, the Acceptable Use Policy, or your representations regarding consent
- Content, scripts, prompts, or data you upload, configure, or transmit through the Service
- Your violation of any third-party right, including privacy, publicity, intellectual property, or contractual rights
- Any dispute between you and a lead, customer, carrier, regulator, or any third party
This indemnification obligation survives termination of these Terms and your use of the Service. We reserve the right, at your expense, to assume exclusive defense and control of any matter subject to indemnification.
15. Termination
You may cancel your account at any time from your account settings. We reserve the right to suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms, our Acceptable Use Policy, or applicable law, or if continued service would expose Josey.ai to material regulatory, carrier, or reputational risk. Upon termination, your right to use the Service ceases immediately and all fees owed become immediately due.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice within the Service. Continued use of Josey.ai after changes take effect constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law provisions. Subject to Section 18, any disputes that are not required to be arbitrated shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and the parties consent to personal jurisdiction and venue therein.
18. Binding Arbitration & Class Action Waiver
Please read this section carefully. It affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service (“Dispute”) shall be resolved exclusively through final and binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules then in effect, rather than in court, except that either party may (a) bring an individual action in small-claims court, or (b) seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information.
- Informal resolution first. Before filing arbitration, the parties agree to attempt to resolve the Dispute informally for at least 60 days following written notice to legal@josey.ai.
- Location. Arbitration will take place in Travis County, Texas, or by videoconference at the arbitrator’s discretion.
- Class action waiver. You and Josey.ai agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of a representative or class proceeding.
- Jury trial waiver. You and Josey.ai waive any right to a jury trial on any Dispute.
- Opt-out. You may opt out of this arbitration agreement by sending written notice to legal@josey.ai within 30 days of first accepting these Terms. Opting out does not affect the other provisions of these Terms.
- Severability. If the class action waiver is found unenforceable, the entirety of this Section 18 is void as to that claim, which shall proceed in court per Section 17.
19. Export & Sanctions
You represent that you are not located in, under the control of, or a national or resident of any country or on any list to which the United States has embargoed goods or services, and that you will not use the Service in violation of U.S. export-control or sanctions laws.
20. Force Majeure
Neither party is liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, carrier outages, internet service disruptions, governmental action, or pandemic.
21. Survival
Sections concerning intellectual property, disclaimers, limitation of liability, indemnification, arbitration, class action waiver, governing law, and any obligations that by their nature should survive termination will survive termination of these Terms.
22. Entire Agreement & Severability
These Terms, together with the Privacy Policy and the Acceptable Use Policy, constitute the entire agreement between you and Josey.ai regarding the Service and supersede all prior agreements. If any provision is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
